Terms of Service

These Terms of Service govern access to and use of MYALEXAI, including the website at myalexai.com, user accounts, chat features, image-processing features, and paid plan features.

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian. The Service is not intended for children under 13.

MYALEXAI is operated by Alex Afanasiev under the MYALEXAI name. Support requests may be sent to support@myalexai.com.

MYALEXAI is an AI-powered writing and chat service. It helps users create short reply suggestions in different tones, including humorous, chill, and confident, and may also provide general AI chat assistance.

The Service may allow users to upload images or screenshots for short-term processing. At this time, uploaded images are processed for OCR and are intended to be deleted within one day.

The Service is provided for general informational, creative, and productivity purposes. It is not legal, medical, mental health, financial, or emergency advice.

You must provide accurate account information and keep your login credentials confidential.

You are responsible for activity that occurs through your account unless you promptly notify MYALEXAI of unauthorized use.

You may delete your account at any time. When you do, the Service is intended to delete your saved account data and chat history associated with that account, subject to limited retention required for security, billing, fraud prevention, legal compliance, or backup restoration windows.

You may not use the Service to break the law, harass others, threaten harm, invade privacy, infringe intellectual property rights, distribute malware, interfere with the Service, or attempt to access accounts or systems without authorization.

You may not use the Service to create, request, or distribute sexual exploitation material, child sexual abuse material, non-consensual sexual content, unlawful pornography, instructions for violent wrongdoing, doxxing content, fraud, impersonation, or content that is otherwise unlawful.

The Service may generate profanity if a user asks for it, but the Service is not offered as an adult-content product and may not be used for sexual-content services, unlawful content, or prohibited commercial uses.

You may not use bots, scraping, reverse engineering, or other automated means to extract the Service, prompts, outputs, or system behavior except as expressly allowed in writing.

You retain ownership of the content you submit to the Service, including text you provide and images you upload, to the extent you own that content.

You grant MYALEXAI a limited, non-exclusive, revocable license to host, process, transmit, and display your content only as needed to operate, secure, maintain, and improve the Service in accordance with the Privacy Policy.

You represent that you have the rights needed to submit your content and that your content does not violate law or the rights of others.

AI-generated outputs may be inaccurate, incomplete, offensive, or unsuitable for your situation. You are responsible for reviewing and deciding whether to use any output.

You should not rely on the Service for decisions involving legal rights, medical treatment, financial risk, safety-critical matters, emergencies, or other high-stakes situations.

MYALEXAI may change output styles, system prompts, moderation rules, or product features at any time.

Some parts of the Service are free, but usage may be capped. Users may be able to purchase additional request packs for USD 5 at a time or subscribe to a membership for USD 15 per month, as offered on the checkout page.

Payments are processed by Stripe. MYALEXAI does not receive or store your full payment card number.

Subscriptions renew automatically until canceled. You may cancel at any time. Unless the checkout page states otherwise, cancellation stops future renewals and your access continues through the end of the current paid billing period.

All purchases are final and non-refundable, except where refunds are required by law or where MYALEXAI chooses, in its sole discretion, to issue a credit or refund.

MYALEXAI may add, remove, suspend, or modify features, pricing, models, limits, or supported regions at any time.

The Service may be unavailable from time to time for maintenance, outages, provider interruptions, security measures, or other reasons. MYALEXAI does not guarantee uninterrupted or error-free operation.

MYALEXAI may suspend or terminate access to the Service, with or without notice, if there is a reasonable belief that you violated these Terms, created risk for others, exposed the Service to legal or security issues, or used the Service in a fraudulent or abusive way.

Sections that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, dispute terms, and intellectual property provisions, will survive.

The Service, including its branding, software, interface design, prompts, workflows, and all related intellectual property other than user content, is owned by MYALEXAI or its licensors and is protected by law.

These Terms do not grant you ownership of the Service or the right to copy, sell, sublicense, or create derivative works from the Service except as allowed by law or with written permission.

The Service relies on third-party providers, including Vercel for hosting and analytics, Supabase for backend infrastructure, Grok/xAI for AI model services, Resend for email delivery, and Stripe for payment processing. Third-party services may have their own terms and privacy practices.

MYALEXAI is not responsible for outages, errors, or acts of third-party providers, although MYALEXAI may work with them to maintain the Service.

THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

MYALEXAI DOES NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYALEXAI AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MYALEXAI AND ITS OPERATOR FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO MYALEXAI FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD 100.

Nothing in these Terms excludes liability that cannot be limited or excluded under applicable law.

You agree to defend, indemnify, and hold harmless MYALEXAI and its operator from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Florida and applicable United States law, without regard to conflict-of-law rules.

You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there, except where applicable law requires another forum.

The Service may be accessed worldwide, but you are responsible for complying with local laws that apply to you. MYALEXAI may restrict access in certain locations or where use would create legal or operational risk.

MYALEXAI may update these Terms from time to time. Updated Terms will be posted on the Service with a revised last updated date. If changes are material, MYALEXAI may also provide additional notice within the Service or by email.

Your continued use of the Service after updated Terms take effect means you accept the updated Terms.
